Terms of Service

These Terms of Service ("Terms") govern your use of the Home Catalog application ("the App"), operated by Moodzy ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Acceptance of Terms
By creating an account or using the App, you confirm that you are at least 13 years of age and that you accept these Terms in full. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Service
Home Catalog is an application that allows you to catalog your personal belongings. You can add items with titles, descriptions, photos, locations, and tags, and access your catalog across multiple devices. The App is available on iOS and Android.
3. Accounts
To use the App, you must create an account using email/password, Google sign-in, or Apple sign-in. You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activity that occurs under your account.
- Notifying us promptly if you suspect unauthorized access to your account.
We are not liable for any loss or damage arising from unauthorized use of your account.
4. Subscriptions and Payments
Home Catalog offers two tiers:
- Free: Track up to 10 items at no cost.
- Pro: Unlimited items for $1.99 per month or $20.00 per year.
Pro subscriptions are billed through the Apple App Store or Google Play Store, depending on your platform. Key details:
- Subscriptions auto-renew unless you cancel at least 24 hours before the end of the current billing period.
- You can manage or cancel your subscription through your App Store or Google Play account settings.
- Refunds are handled by Apple or Google in accordance with their respective refund policies. We do not process refunds directly.
- Prices may change with advance notice. Continued use after a price change constitutes acceptance of the new price.
5. User Content
You retain full ownership of the content you create in the App, including item data, descriptions, and photos ("User Content"). By using the App, you grant us a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing the service to you.
We do not sell, share, or use your User Content for advertising or any purpose unrelated to operating the App.
6. Prohibited Uses
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable law.
- Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
- Attempt to gain unauthorized access to our systems or other users' accounts.
- Reverse engineer, decompile, or disassemble the App.
- Use the App to store or transmit malware or malicious code.
- Abuse the service in a manner that degrades performance for other users.
7. Termination
We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to the service or other users. You may delete your account at any time by contacting us at moodzy.apps@gmail.com. Upon account deletion, your data will be removed in accordance with our Privacy Policy.
8. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Moodzy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or related to your use of or inability to use the App, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for all claims arising from or related to the App shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in California.
11. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. We encourage you to review these Terms periodically. Your continued use of the App after any changes constitutes your acceptance of the updated Terms.
